Build American Efficiency Act

This bill clarifies the evidentiary requirements for domestic content certification under the Build America, Buy America Act, specifically for financial assistance administered by the Department of Housing and Urban Development (HUD). It mandates that the Secretary of HUD shall treat documentation generated in accordance with the Make It American Process Standard (NEMA 70901–2024) as sufficient evidence for determining a funding recipient’s compliance with applicable domestic content requirements, thereby streamlining the certification process.

The legislation clarifies that recipients are not required to use this specific standard and may utilize any other legally permitted method for certification. Additionally, the Secretary has the discretion to approve similar standards that provide an auditable and verifiable domestic content certification process, ensuring flexibility while maintaining accountability for domestic content verification.
