This legislation empowers federal agencies to establish rules governing the use of algorithmic decision-making systems . This authority applies when an agency determines that such systems are likely to materially contribute to violations of federal laws that the agency is authorized to enforce, with the primary goal of mitigating these violations. A violation of these new rules would be treated as a violation of the underlying federal law for enforcement purposes. To ensure a coordinated and transparent approach, the bill requires agencies to publish an advanced notice of proposed rulemaking to solicit public comment. Agencies must also engage in extensive consultation, including with the Office of Information and Regulatory Affairs to prevent conflicts and with the Office of Science and Technology Policy and the National Institute of Standards and Technology on technical aspects of the systems being regulated. Coordination with other agencies is also mandated to avoid imposing conflicting requirements. The Act includes provisions for mitigating disruption to government services or public benefits when regulating these systems, especially those administered by contractors. Furthermore, agencies must periodically review their rules, at least every five years, to ensure they remain appropriate given technological advancements and are appropriately tailored. Finally, the bill mandates biennial reports to Congress on rulemaking activities, enforcement actions, and challenges encountered, promoting transparency and accountability in AI governance.
