This bill amends Section 523(d) of title 11 of the U.S. Bankruptcy Code to address abusive student loan collection practices in bankruptcy cases. It allows debtors to recover attorney's fees and costs if a creditor unsuccessfully opposes a debtor's request to discharge a student loan based on undue hardship . This recovery is permitted when the creditor's position was not substantially justified, extending a protection previously available for other debts to student loans. The primary goal is to deter creditors from engaging in unwarranted litigation tactics against debtors seeking student loan discharge. This Act will take effect upon enactment and apply to bankruptcy cases commenced on or after that date.
