This bill, titled the "Digital Opportunity Foundation Act of 2026," establishes the Foundation for Digital Opportunity as a nonprofit corporation. Its core mission is to supplement the work of the National Telecommunications and Information Administration (NTIA) and the Federal Communications Commission (FCC) in promoting technological development and affordable broadband connectivity across the United States. The Foundation will focus on enhancing digital opportunity and digital literacy, especially for communities with low rates of broadband adoption and other digital technologies. The Foundation is authorized to raise, leverage, and match funding from various sources, including philanthropic organizations, the private sector, and state and local governments. It will develop programs and partnerships to increase broadband adoption, promote digital literacy, upskill individuals, and prepare for emerging technologies like artificial intelligence. These efforts involve collaboration with diverse stakeholders such as state, local, and Tribal governments, Minority-serving institutions, and community anchor institutions, while also supporting existing federal broadband initiatives. Governance of the Foundation will be overseen by a Board of Directors , comprising both ex officio federal officials and at least 15 appointed members. These appointed members must represent a broad cross-section of stakeholders, including academia, industry, nonprofits, and community-based practitioners, and possess experience in digital opportunity or working with covered populations. The Board is responsible for appointing an Executive Director, establishing bylaws, soliciting funds, and evaluating the Foundation's performance. The Foundation's activities include conducting studies, competitions, and projects, as well as awarding grants for digital literacy and adoption initiatives. It may also establish for-profit subsidiaries, such as an impact investment fund, to stimulate economic development and attract private investment in digital inclusion efforts. To ensure accountability, the Foundation must submit a strategic plan within one year and recurring biennial reports to Congress, detailing its activities, funding, and progress, with the Comptroller General conducting evaluations every five years.
