This bill expresses the Sense of Congress regarding the safety and federal regulation of medication abortion. It asserts that medication abortion is an extremely safe medical treatment, which the Commissioner of Food and Drugs appropriately approved based on scientific evidence under the Federal Food, Drug, and Cosmetic Act. The bill further states that this federal approval preempts any State law establishing, implementing, or enforcing requirements for medication abortion to be dispensed by a healthcare practitioner in person. It also preempts any State prohibition or restriction on prescribing or dispensing medication abortion by means of telehealth, thereby reinforcing federal authority over such state-level regulations.
