This bill amends title XVIII of the Social Security Act to grant states explicit authority to enforce requirements for Medicare Advantage (MA) plans offered within their borders. It specifically allows each state to require that MA organizations issuing, selling, renewing, or offering MA plans within its jurisdiction meet the federal requirements outlined in that part of the Act, thereby empowering states with greater regulatory oversight. The legislation further mandates that the Secretary coordinate enforcement of these standards with the states where an MA organization is licensed and where it operates. To enhance this collaboration, the Secretary is authorized to enter into collaborative enforcement agreements with states, aiming to strengthen oversight and ensure compliance of Medicare Advantage plans at the state level.
Referred to the Committee on Ways and Means, and in addition to the Committee on Energy and Commerce, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned.
