This bill amends the Clean Air Act to establish an enhanced penalty structure for investor-owned electric or gas utilities found to be operating noncomplying stationary sources. It mandates that the State or Administrator must adjust the amount of an assessed penalty by increasing it if the utility has either received a rate increase in the two-year period preceding the original penalty assessment or seeks one in the two-year period following it. For each instance of such a rate increase, the penalty is increased by an amount equal to the original assessment, effectively doubling the penalty . This enhancement applies irrespective of whether a sought rate increase is ultimately approved or remains pending before a regulatory authority, aiming to hold utilities accountable for both environmental compliance and rate adjustments.
