This legislation establishes a prohibition on the detention and removal of certain Vietnamese nationals from the United States. To qualify for this protection, an individual must be a national of Vietnam, have entered the U.S. on or before July 12, 1995 , and have continuously resided in the country since that date, while also being subject to a final order of removal. However, these protections do not extend to individuals whom the Secretary of Homeland Security determines, based on credible facts, are directly responsible for harming U.S. security , or to those who are subject to extradition. For all eligible Vietnamese nationals, the Secretary of Homeland Security is mandated to authorize employment in the United States and provide appropriate work permits. Furthermore, the bill requires the Secretary to provide notice of these provisions to all eligible aliens within 60 days of enactment, including instructions for filing a motion to reopen removal proceedings, and establishes a right to judicial review for violations.
