Protecting American Consumers from Robocalls Act

This legislation, known as the "Protecting American Consumers from Robocalls Act," significantly strengthens consumer protections against unwanted calls by expanding the scope of the Do Not Call rules under the Telephone Consumer Protection Act to cover all telephone subscribers, moving beyond the current limitation to residential lines. It also enhances the private right of action, allowing individuals to pursue legal action for a single violation of the Do Not Call rules, rather than requiring multiple calls within a specific period, thereby making it easier for consumers to seek recourse against telemarketers.

Crucially, the Act modifies the definition of an automatic telephone dialing system (ATDS). This revised definition now explicitly includes systems that dial from a list of telephone numbers, in addition to those using random or sequential number generators, provided they dial "successively without human intervention." These comprehensive changes aim to broaden the applicability of robocall restrictions and empower consumers.
