This bill, titled the Privacy Protection Updates Act, significantly amends the Privacy Protection Act of 1980 to enhance safeguards for newsgathering records. A key provision introduces an exclusionary rule , stipulating that materials and evidence derived from them, if searched or seized in violation of the Act, cannot be used or disseminated in any federal, state, or local investigation, trial, or proceeding. This rule allows an aggrieved person to move to suppress such unlawfully obtained materials. The legislation mandates more rigorous procedures for government officers seeking warrants to search for or seize covered materials. Warrant applications must now include a detailed factual basis justifying the applicability of an exception, disclose any information that might question the accuracy of the application, and identify all targets of the investigation. Furthermore, courts must find that an exception permits the search and, for certain offenses, that the prosecution is consistent with the First Amendment , while also imposing limitations to prevent unjustified seizures and mitigate potential harms. In cases of immediate harm, officers may conduct a search without a prior warrant, but they must take reasonable measures to limit the scope and submit a detailed application to a court within 48 hours for review. If the court determines the search was not justified, the materials must be returned and destroyed. The bill also clarifies that for materials stored on electronic communication or remote computing services, the customer or subscriber is deemed to possess them , thereby extending the Act's protections to cloud-based data.
