Exemptions apply for information subject to confidentiality provisions , court orders, or Freedom of Information Act withholding. The Director of the Office of Management and Budget will issue guidance on data standards, publication frequency, and criteria for designating covered agreements. Agencies must also report annually to Congress on agreements not publicly disclosed, specifying the reasons for exemption. The requirements apply to new covered agreements and, where feasible, to those from January 1, 2015 , that are still active. The bill clarifies that publication does not alter agreement terms or create new legal rights, nor does it override existing protections for classified or FOIA-exempt information.
