Federal agencies would be required to establish and maintain public online databases for "covered settlement agreements" to increase transparency. These agreements are broadly defined to include those with significant financial obligations ( $10,000,000 or more), involving special oversight, or a state or local government, while excluding certain personnel or tax-related matters. Each database must publish a searchable list of agreements, detailing whether claims are civil or criminal, execution dates, alleged statutory violations, and specific payment amounts, including attorney fees and penalties, along with a copy of the agreement. Exemptions apply for information subject to confidentiality provisions , court orders, or Freedom of Information Act withholding. The Director of the Office of Management and Budget will issue guidance on data standards, publication frequency, and criteria for designating covered agreements. Agencies must also report annually to Congress on agreements not publicly disclosed, specifying the reasons for exemption. The requirements apply to new covered agreements and, where feasible, to those from January 1, 2015 , that are still active. The bill clarifies that publication does not alter agreement terms or create new legal rights, nor does it override existing protections for classified or FOIA-exempt information.
