GAP Supply Act

This bill amends Section 503B of the Federal Food, Drug, and Cosmetic Act to enhance the ability of outsourcing facilities to mitigate drug shortages. It specifically modifies provisions governing the compounding and distribution of drugs by these specialized facilities. The core change allows outsourcing facilities to continue supplying a drug for up to 180 calendar days after it is no longer officially designated as being in shortage. This extends the previous allowance which only permitted supply "at the time" a drug was in shortage. By providing this short-term "tail period," the legislation aims to prevent immediate supply disruptions and ensure a more stable market for critical medications.
