However, significantly higher penalties, up to 10 years, are introduced for aliens with prior convictions for certain misdemeanors or felonies, those excluded for national security reasons, or individuals removed three or more times. Furthermore, a mandatory minimum sentence of 5 to 20 years is established for aliens with prior aggravated felony convictions or at least two previous illegal reentry convictions, and the definition of "removal" is clarified to include stipulations made during criminal trials.
