The "Stop Illegal Reentry Act" aims to strengthen enforcement against individuals who unlawfully return to the United States after having been removed. The legislation redefines and expands the categories of aliens subject to increased punishment for illegal reentry. Under the proposed changes, the standard penalty for illegal reentry would be up to 5 years imprisonment. However, significantly higher penalties, up to 10 years, are introduced for aliens with prior convictions for certain misdemeanors or felonies, those excluded for national security reasons, or individuals removed three or more times. Furthermore, a mandatory minimum sentence of 5 to 20 years is established for aliens with prior aggravated felony convictions or at least two previous illegal reentry convictions, and the definition of "removal" is clarified to include stipulations made during criminal trials.
