DHS Intelligence Transparency and Oversight Program Office and Ombuds Act

This legislation amends the Homeland Security Act of 2002 to establish an Intelligence Transparency and Oversight Program Office and an Intelligence Ombuds within the Department of Homeland Security (DHS). The primary goal is to enhance the integrity and public understanding of DHS intelligence activities by ensuring they are objective and independent from political considerations. The Office will specifically review and assess intelligence operations for timeliness, objectivity, and independence, while also facilitating public information release to increase transparency. The Ombuds, a senior career employee with expertise in intelligence and civil rights, will lead this office, reporting directly to the Under Secretary for Intelligence and Analysis and to Congress on urgent matters. This role involves serving as the Department's principal advisor on safeguarding objectivity and ensuring intelligence activities are independent of political influence, promoting awareness of privacy and civil liberties, and providing confidential forums for individuals to raise concerns regarding potential abuses or politicization in intelligence collection and analysis. The Ombuds is empowered to initiate reviews and make recommendations to DHS intelligence components, which must formally respond within 60 days, and the Secretary of Homeland Security is mandated to ensure the Ombuds has access to all necessary departmental information. Annually, the Ombuds will submit reports to relevant congressional committees detailing their activities, findings, and recommendations, ensuring ongoing oversight and accountability.
