This legislation requires all data centers in the United States to generate 100% of the electricity they consume annually . This mandate applies to facilities described in section 453(a)(1) of the Energy Independence and Security Act of 2007 that consume at least 50 megawatts each day. The bill establishes a phased transition for clean energy use, requiring at least 75 percent of generated electricity to be from clean energy sources by January 1, 2035 , and 100 percent by January 1, 2040 . Clean energy sources include solar, wind, battery, green hydrogen, hydropower, and geothermal. Data centers failing to comply will face a civil penalty of up to $100,000 per day, with the Secretary of Energy establishing an administrative process for enforcement.
