Domestic SUPPLY Act of 2025

This bill mandates the Secretary of Health and Human Services, in collaboration with the Assistant Secretary for Preparedness and Response and the Director of the Centers for Disease Control and Prevention, to establish a program. This program will involve entering into partnerships with eligible domestic manufacturers to guarantee the availability of qualified personal protective equipment for preparing for and responding to public health emergencies. The Secretary must finalize a process for these contractual purchasing agreements within one year, which will ensure dedicated supplies and manufacturing lines. To qualify, manufacturers must be headquartered in the continental United States, be majority owned by U.S. citizens, and progressively increase their U.S.-based manufacturing to 100% by 2028 for products supplied under the partnership. They must also verify supply chain security and attest that their products meet or exceed CDC and OSHA quality guidelines. Qualified personal protective equipment must meet specific quality standards, be FDA-cleared, and be priced using fair-market benchmarks established by the Secretary. Furthermore, the bill prohibits federal funds from being used by federal, state, or local agencies to procure clothing or equipment for infectious disease prevention manufactured outside the United States, with certain exceptions requiring detailed justification. Finally, it requires a report to Congress within one year on the impact of changes to federal PPE requirements since the beginning of the COVID-19 pandemic on frontline worker safety.
