This legislation mandates significant structural changes within the Department of Homeland Security. Its primary purpose is to transfer Homeland Security Investigations (HSI) from its current placement within U.S. Immigration and Customs Enforcement (ICE) to become a distinct, separate entity within the Department. This transfer is required to be completed within two years of the bill's enactment. Upon transfer, HSI will be led by a Director of Homeland Security Investigations , appointed by the President with Senate confirmation, and will also gain a Chief Counsel for specialized legal advice. The bill specifies that HSI's functions will remain consistent with its activities prior to the transfer. The Secretary of Homeland Security, in consultation with the Attorney General, must develop and publicly issue updated investigative guidelines for HSI within two years, covering areas like surveillance technologies and protection of sensitive information. Concurrently, the bill renames U.S. Immigration and Customs Enforcement as U.S. Immigration Compliance Enforcement, also to be headed by a Senate-confirmed Director. Furthermore, the legislation requires a joint review by the Secretary of Homeland Security and the Attorney General to assess HSI's role relative to other federal law enforcement agencies. This review will lead to a memorandum of agreement to clarify jurisdictional overlaps, particularly in areas such as: transnational criminal investigation intellectual property human trafficking online child sexual exploitation narcotics financial crime
