The "Protect Minors from Medical Malpractice Act of 2025" aims to safeguard individuals under 18 from medical malpractice related to gender-transition procedures. It establishes a private right of action , allowing individuals who received such procedures as minors to sue medical practitioners for any resulting physical, psychological, emotional, or physiological harms. This civil action can be brought up to 30 years after the individual turns 18, seeking declaratory or injunctive relief, compensatory damages, punitive damages, and attorney's fees. The right of action applies if the procedure involved interstate commerce, such as travel, payment, or communication, or occurred within U.S. jurisdiction. The bill also protects medical providers' autonomy, stating that no federal law shall compel a practitioner to perform a gender-transition procedure, thus upholding freedom of conscience and medical judgment . Additionally, any state mandating medical practitioners to perform these procedures on minors will be ineligible for federal funding from the Department of Health and Human Services. A "gender-transition procedure" is defined as the prescription of puberty blockers, cross-sex hormones, or surgery intended to align an individual's body with their subjective identity when it conflicts with their biological sex . Exceptions are made for interventions addressing ambiguous biological sex characteristics, treating complications, or procedures necessary to prevent imminent death or severe bodily impairment.
