This bill proposes to amend the Higher Education Act of 1965 to mandate that public institutions of higher education provide in-state tuition rates to certain residents of U.S. territories. Specifically, it prohibits these institutions, if they receive federal assistance, from charging higher tuition to eligible individuals than they would charge residents of the state where the institution is located. An individual is considered "covered" if they are a resident of Guam, the Commonwealth of the Northern Mariana Islands, American Samoa, or the United States Virgin Islands, and are also a national of the United States . To ensure compliance, the bill also amends the requirements for an institution's Program Participation Agreement , making adherence to these in-state tuition provisions a condition for receiving federal student aid funds.
