The "Combatting China's Pilfering of Intellectual Property Act" aims to deter and punish significant intellectual property theft by individuals and entities operating within the People's Republic of China. It mandates the President to impose sanctions on persons determined to have engaged in a pattern of significant IP theft from a United States person, or to have received such stolen IP. These sanctions include the blocking of assets within U.S. jurisdiction and rendering individuals ineligible for U.S. visas , admission, or parole, with existing visas subject to revocation. The bill defines targeted persons as Chinese nationals or entities organized under Chinese law, or those owned or controlled by Chinese nationals or entities. The President retains the authority to waive sanctions on a case-by-case basis if it serves U.S. national security interests, provided a justification is submitted to Congress. Sanctions can also be terminated if the President certifies that the person is no longer involved in IP theft. Furthermore, the legislation imposes broader visa restrictions on specific categories of individuals, including senior officials of the Chinese Communist Party , their spouses and children, members of the Chinese government cabinet, and active-duty members of the People's Liberation Army. These visa restrictions can only be lifted if the President certifies that the Chinese government has ceased its sponsorship, funding, and facilitation of intellectual property infringement against U.S. citizens and entities. The bill also requires reports from the President and the Secretary of State on sanctioned persons and the efficacy of visa screening mechanisms related to IP theft.
