This bill amends the Tariff Act of 1930 to modify the procedures for investigating claims of evasion of antidumping and countervailing duty orders. A key change allows the Commissioner to self-initiate an investigation if there is information that reasonably suggests covered merchandise has been entered into the U.S. customs territory through evasion. The terms and conditions applicable to other allegations and referrals will also apply to these self-initiated investigations. Furthermore, the bill modifies the conditions for judicial review for those found to have evaded duties. A person determined to have entered merchandise through evasion may only seek judicial review if all liquidated duties, charges, or exactions have been fully paid at the time the review is sought. This provision aims to ensure compliance before legal challenges are pursued.
