Ban AI Denials in Medicare Act

This bill aims to prevent the implementation of prior authorization requirements within traditional Medicare. Specifically, it prohibits the Secretary of Health and Human Services from implementing the proposed Wasteful and Inappropriate Services Reduction (WISeR) Model , or any similar model, which involves prior authorization for select Medicare services. Furthermore, the legislation amends the Social Security Act to impose a broad prohibition on future innovative payment and service delivery models developed by the Center for Medicare and Medicaid Innovation. This amendment ensures that the Secretary cannot select or test any model that would implement prior authorization , including those utilizing artificial intelligence , for services covered under Medicare Part A or Part B. The overall intent is to safeguard traditional Medicare beneficiaries from potential delays or denials of care resulting from prior authorization mandates.
