This legislation, known as the Dark Web Interdiction Act of 2025, aims to combat the distribution of controlled substances, particularly opioids , through the dark web . It establishes a new criminal offense under the Controlled Substances Act for knowingly or intentionally delivering, distributing, or dispensing controlled substances via the dark web , or aiding such activities. Violations of this new offense will incur a 2-level increase in sentencing guidelines, reflecting the severity of using anonymous online networks for illicit drug trade. To address this threat, the bill establishes the Joint Criminal Opioid and Darknet Enforcement Task Force (J-CODE) within the Federal Bureau of Investigation. Headed by a Senate-confirmed Director, the task force's primary purpose is to detect, disrupt, and dismantle illicit marketplaces on the dark web . It comprises representatives from key federal agencies, including: the Federal Bureau of Investigation; the Drug Enforcement Administration; the United States Postal Inspection Service; Immigration and Customs Enforcement; the Bureau of Alcohol, Tobacco, Firearms and Explosives; Homeland Security Investigations; United States Customs and Border Protection; the Department of Defense; the Financial Crimes Enforcement Network; and the Department of Justice. The J-CODE Task Force is mandated to conduct proactive and reactive investigations, perform forensic examinations, and provide training and assistance to law enforcement and prosecutors. Its duties include developing best practices for evidence collection, fostering multijurisdictional partnerships for information sharing, and creating novel investigative approaches to target emerging technologies. The Director of the FBI, through the Task Force Director, must submit annual reports to Congress detailing the task force's activities, performance measures, and recommendations for legislative action, though this section of the Act is set to sunset after five years. Additionally, the bill requires the Attorney General, in consultation with the Secretaries of Treasury and Homeland Security, to submit a report to Congress within one year. This report will analyze the use of virtual currencies in financing opioid distribution through illicit marketplaces on the dark web , assessing investigative capacities and offering recommendations for improvement. Finally, Congress expresses a sense that the definition of the term " dark web " should be evaluated and updated periodically, at least every five years, to remain current with technological advancements.
