This legislation amends the National Flood Insurance Act of 1968 to increase the availability of flood insurance for agricultural structures. It allows state and local land use controls to grant variances from standard elevation or floodproofing requirements for agricultural structures located in special flood hazard zones. These variances are subject to strict conditions, such as an official determination that elevation or floodproofing is impracticable for new or substantially damaged structures, and that the structure is not situated in high-risk areas like regulatory floodways or zones with high-velocity wave action. Additional requirements for granting a variance include ensuring it will not increase flood heights or public safety threats, and that the structure has not had more than one flood insurance claim exceeding $1,000 within a 10-year period. Communities that adopt these variance provisions will not be penalized by the Federal Emergency Management Agency. The bill also authorizes the Administrator to offer optional umbrella flood insurance policies for properties with multiple structures, encompassing agricultural, commercial, and residential properties, with purchase at actuarially sound rates. A report on the implementation of these umbrella policies is mandated for Congress within five years.
