This legislation aims to prevent veterans from being improperly disqualified from purchasing firearms based on certain determinations made by the Department of Veterans Affairs. It mandates that the Secretary of Veterans Affairs notify the Attorney General within 30 days of enactment that the previous transmission of personally identifiable information to the National Instant Criminal Background Check System (NICS) , solely due to a VA determination requiring a fiduciary for benefit management, was improper or no longer applies. Furthermore, the bill clarifies that for the purposes of federal firearm laws, a person shall not be considered "adjudicated as a mental defective" solely because the VA has determined they are mentally incompetent or require a fiduciary under specific VA regulations. This ensures that veterans who have a fiduciary appointed to manage their benefits, or are deemed mentally incompetent by the VA for benefit purposes, are not automatically prohibited from owning firearms, thereby restoring their Second Amendment rights.
