This legislation, known as the Greater Yellowstone Recreation Enhancement And Tourism Act , aims to amend the Wild and Scenic Rivers Act. Its primary purpose is to designate certain segments of the Gallatin, Madison, and Yellowstone Rivers and their select tributaries within the Greater Yellowstone Ecosystem in Montana as components of the National Wild and Scenic Rivers System, thereby preserving their outstandingly remarkable values for present and future generations. The bill specifically designates five segments for inclusion: an approximately 42-mile segment of the Madison River as a recreational river, an approximately 39.5-mile segment of the Gallatin River as a recreational river, an approximately 4.6-mile segment of Hyalite Creek as a scenic river, an approximately 7.3-mile segment of Cabin Creek as a scenic river, and an approximately 5.1-mile segment of the Middle Fork of Cabin Creek as a scenic river. All these newly designated segments are to be administered by the Secretary of Agriculture. The designations are intended to maintain the streams' outstanding values while preserving public access and respecting private property rights , requiring owner consent for any land acquisition. Furthermore, the Act allows for appropriate maintenance of existing infrastructure, including major repairs to roads and bridges, and permits emergency intervention and the continuation of historical uses. Crucially, the bill clarifies that these designations do not affect valid existing water rights , including Federal, Tribal, and State compacts, or water rights held by the United States. It also explicitly states that the designations will not impact the existing operations or future licensing and expansion of the Hebgen Dam and Madison Dam , which are located outside the designated segments, allowing the Federal Energy Regulatory Commission to govern these facilities under the Federal Power Act.
