The "Equal Access to Abortion Coverage in Health Insurance Act of 2025," or the EACH Act of 2025 , seeks to guarantee affordable abortion coverage and care for every person in the United States. This legislation is introduced in response to findings that access to abortion services is hindered by income, insurance type, and post- Dobbs v. Jackson Women's Health Organization state bans, disproportionately affecting women of color, low-income individuals, and LGBTQ people. A core provision of the bill mandates that all federal health programs or plans , including Medicaid, Medicare, CHIP, TRICARE, and the Indian Health Service, must provide coverage for abortion services. Furthermore, the federal government, in its role as a healthcare provider, is required to ensure access to these services in its own facilities or through contracted providers. This aims to eliminate existing federal funding bans that have historically limited abortion access for millions. The bill also addresses private insurance by explicitly prohibiting the federal government from restricting or inhibiting insurance coverage of abortion services by state, local, or private health plans. Significantly, it repeals Section 1303 of the Patient Protection and Affordable Care Act , which currently allows states to prohibit abortion coverage in marketplace and private plans. This Act is designed to supersede all other federal laws, including the Religious Freedom Restoration Act of 1993 , to ensure its provisions are fully implemented without impediment.
