This legislation revises federal law concerning the appointment of acting Inspectors General (IGs) when a position becomes vacant. It modifies existing requirements, stipulating that a Principal Deputy or Deputy IG must have served in their role for at least 180 of the preceding 365 days to automatically assume the acting IG position. If the first assistant to a Presidentially-appointed IG position is vacant, unavailable, or declines to serve, a new, more independent appointment process is triggered. Under this new process, a judge, randomly selected by the chief judge from the appropriate U.S. Court of Appeals, is tasked with appointing the acting Inspector General. The Chairperson of the Council of the Inspectors General on Integrity and Efficiency (CIGIE) must convene a committee of three Inspectors General to recommend at least two qualified candidates to this judge within 14 days. The judge then has 14 days to make the appointment, holding sole authority for this selection until the permanent vacancy is filled, thereby enhancing the independence of acting IG appointments by involving the judiciary.
