This bill grants the Bay Mills Indian Community of Michigan the authority to transfer, lease, encumber, or otherwise convey its interests in real property. This authorization applies to any land or interests in land owned by the Tribe that are not held in trust by the United States . The Tribe can exercise this power without requiring further federal authorization or approval. Importantly, this legislation explicitly states that it does not authorize the Tribe to convey lands or interests that are held in trust by the United States. Furthermore, the United States will not be held liable for any terms or losses resulting from transactions made under this Act, unless the U.S. is a direct party to the transaction or otherwise legally responsible. This liability exclusion does not apply if the Tribe transfers land to the U.S. to be held in trust.
