This legislation seeks to make state and local jurisdictions that do not cooperate with federal immigration enforcement ineligible for federal financial assistance. It directs the Attorney General to annually identify jurisdictions that fail to comply with federal statutes concerning information sharing with immigration authorities or requests from the Department of Homeland Security for detainers or release notifications. Once identified as non-compliant, a jurisdiction would be ineligible to receive Federal financial assistance for a minimum period of one year. Reinstatement of eligibility would only occur after the Attorney General certifies that the jurisdiction has returned to compliance. Additionally, the Attorney General must provide a compliance report for any specific jurisdiction upon request from a Member of Congress.
Referred to the Committee on the Judiciary, and in addition to the Committee on Oversight and Government Reform, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned.
