This bill amends the Immigration and Nationality Act to establish new grounds for the removal and permanent inadmissibility of certain aliens. Specifically, it targets aliens convicted of, or who admit to committing acts constituting, incitement to violence or physical participation in a riot or civil disturbance under Federal, State, or local law. These acts must involve an actual or attempted assault, battery, or use of force against a law enforcement officer or member of the Armed Forces , or the willful destruction of public property . The new provisions apply to aliens who were unlawfully present, DACA recipients, or lawful permanent residents at the time of the offense. Aliens removed under these grounds will be permanently inadmissible to the United States and rendered ineligible for any form of relief from removal, including asylum, cancellation of removal, adjustment of status, and future DACA benefits. The bill also mandates enhanced enforcement during declared emergencies, allowing for expedited removal and mandatory detention for these offenses.
