This bill amends both the Federal Insecticide, Fungicide, and Rodenticide Act and the Federal Water Pollution Control Act to clarify the regulatory framework for pesticide use in or near navigable waters. Specifically, it states that the Administrator or a State may not require a permit under the Federal Water Pollution Control Act for the discharge of a pesticide authorized for sale, distribution, or use, or its residue, from a point source into navigable waters. This aims to reduce regulatory burdens by streamlining the permitting process for pesticide applications. However, the bill outlines several important exceptions where a permit would still be required. These include discharges resulting from the application of a pesticide in violation of the Federal Insecticide, Fungicide, and Rodenticide Act if the violation impacts water quality or the amount of discharge. Additionally, stormwater discharges , manufacturing or industrial effluent, treatment works effluent, and discharges incidental to the normal operation of a vessel, such as from ballasting or biofouling prevention, remain subject to existing permit requirements.
