SAFE Act

This legislation aims to prevent the use of United States Federal funds to support the detention of individuals by foreign governments or entities under specific circumstances. It establishes a clear prohibition on the obligation or expenditure of any Federal funds for such payments. The key condition for this prohibition is that a court of the United States must have determined that the detention in question violates the laws of the United States . This ensures that U.S. financial resources are not used, directly or indirectly, to facilitate detentions that American courts deem unlawful. The bill also defines a "foreign entity" as any entity not organized under U.S. law.
