Additionally, they would be required to observe a curfew , staying at their compliant home address between 10 p.m. and 5 a.m. A key provision of the bill states that any alien who fails to comply with a condition of their release order shall be ordered removed in absentia by an immigration judge upon an immigration officer's affidavit. Furthermore, the bill imposes strict limitations on participation in Alternatives to Detention programs, allowing release into such a program only when all available detention beds are filled, no other detention options exist, and the Secretary has exhausted all reasonable efforts to hold aliens in detention.
