This bill, known as the "No Subsidies for Gender Transition Procedures Act," aims to significantly restrict federal financial support for gender transition procedures by denying tax deductions and prohibiting their coverage under major federal healthcare programs. This includes amending the Internal Revenue Code and the Social Security Act to implement these changes. Specifically, the bill would amend the Internal Revenue Code to exclude "gender transition procedures" from the definition of medical care eligible for tax deductions. It broadly defines these procedures to encompass various hormonal and surgical interventions undertaken for the purpose of gender transition, including puberty blockers, hormone therapy, and numerous surgical procedures. However, it explicitly excludes treatments for medically verifiable disorders of sex development , complications from prior procedures, and interventions for physical illnesses posing imminent danger. Furthermore, the legislation prohibits the use of federal funds for specified gender transition procedures under Medicaid , the Children's Health Insurance Program (CHIP) , and Medicare . For CHIP, this prohibition specifically applies to minors. The bill also mandates that the Secretary of Health and Human Services shall not include gender transition procedures as part of the essential health benefits under the Patient Protection and Affordable Care Act.
