This bill, known as the "Retired Pay Restoration Act," seeks to eliminate the long-standing practice of reducing military retired pay for service members who also receive veterans' disability compensation. It expands the eligibility for concurrent receipt , allowing more retired members of the Armed Forces with service-connected disabilities to receive both their full retired pay and disability benefits. A key provision of the bill amends title 10, United States Code, to permit retired service members with service-connected disabilities rated less than 50 percent to receive both forms of compensation. This change removes previous restrictions and phase-in requirements that limited concurrent receipt to those with higher disability ratings or combat-related disabilities. The legislation defines a "qualified retiree" as an individual entitled to both retired pay and veterans' disability compensation, with specific exclusions for certain Chapter 61 retirees. The Act reflects a Congressional intent that military retired pay, earned through service, should not be offset by disability compensation awarded for service-connected conditions. By extending concurrent receipt to a broader group of disabled retirees, the bill aims to address financial inequities, with the amendments taking effect retroactively for payments beginning on or after January 1, 2021 .
