This legislation amends the Family and Medical Leave Act of 1993 (FMLA) to protect employees who take leave for the birth of a child. Under this bill, which may be cited as the "Fairness for Stay-at-Home Parents Act," an employer is prohibited from recovering any health care premiums paid on behalf of an employee if that employee chooses not to return to work following leave taken due to the birth of a son or daughter. Additionally, the bill introduces a new requirement for employers. They must now notify any eligible employee taking leave for childbirth that the employer is prohibited from recovering health care premiums paid for maintaining coverage, even if the employee does not return to work after the leave.
