This bill amends the Federal Food, Drug, and Cosmetic Act to significantly expand the authority of the Secretary of Health and Human Services regarding imported articles. It grants the Secretary the power to destroy any article refused admission if it is determined to present a significant public health concern , broadening the scope from only drugs and devices to include "other articles." Additionally, the legislation establishes that the unauthorized movement or introduction into interstate commerce of an article designated for destruction by the Secretary constitutes a prohibited act . These amendments are set to apply 180 days after the bill's enactment. The Secretary is also required to finalize implementing regulations within 90 days, ensuring they align with any applicable international agreements.
