Fair Access to Agriculture Disaster Programs Act

The "Fair Access to Agriculture Disaster Programs Act" amends the Food Security Act of 1985 to establish an exception to certain payment limitations for agricultural assistance programs. This bill aims to provide greater access to disaster aid for those who primarily derive their income from farming. Under this exception, payment limitations will not apply to a person or legal entity if 75 percent or more of their average adjusted gross income comes from farming, ranching, or silviculture activities. These activities are broadly defined to include agri-tourism, direct-to-consumer marketing, and the sale of agricultural equipment. The exception specifically applies to "excepted payments or benefits," which include various disaster assistance programs under the Agricultural Act of 2014 and programs like the Livestock Indemnity Program and Tree Assistance Program under the Federal Agriculture Improvement and Reform Act of 1996.
