This legislation aims to significantly streamline the process for exporting and importing natural gas by repealing current restrictions. It amends the Natural Gas Act to grant the Federal Energy Regulatory Commission (FERC) exclusive authority over the approval or denial of applications for the siting, construction, expansion, or operation of natural gas export and import facilities, including Liquefied Natural Gas (LNG) terminals . A key provision mandates that FERC shall deem the exportation or importation of natural gas to be consistent with the public interest when evaluating applications, effectively removing a discretionary public interest test. While centralizing approval with FERC, the bill also explicitly preserves the President's existing authority under various acts, such as the International Emergency Economic Powers Act, to prohibit imports or exports. This presidential power can be exercised, for instance, against sanctioned foreign persons, foreign governments, or countries designated as state sponsors of terrorism, ensuring national security considerations remain paramount.
