This legislation aims to broaden the criteria for facilities to be designated as rural emergency hospitals (REHs) under the Medicare program. It specifically creates a new pathway for certain hospitals that previously ceased operations to re-open as REHs. To qualify, a facility must have been either a critical access hospital or a rural subsection (d) hospital between January 1, 2014, and December 26, 2020, and must have been closed as of the bill's enactment date. The bill also introduces specific modifications to the payment rules for these newly eligible REHs. A 5% increase in Medicare payments will not apply to these facilities if they are located less than 35 miles from another hospital, critical access hospital, or rural emergency hospital at the time of their application. Furthermore, these facilities will not receive the standard monthly facility payment if they are located less than 10 miles from another such healthcare provider. These changes are set to take effect beginning January 1, 2027.
