This bill, titled "Ethan's Law," aims to enhance public safety by requiring the secure storage of firearms in residential settings. It makes it unlawful to store a firearm where a minor is likely to gain unauthorized access or where a resident ineligible to possess a firearm could obtain it. This measure seeks to reduce unintentional shootings, youth suicides, and firearm theft by ensuring responsible gun ownership practices. To comply with the law, firearm owners must either keep their weapons secured with a safe gun storage or safety device , or in a location a reasonable person would consider secure. An exception is made for firearms carried on one's person or within close proximity for immediate use. Violations carry a penalty of a $500 fine, with an enhanced penalty of up to five years imprisonment and additional fines if a minor or ineligible individual obtains the firearm and causes injury or death. The legislation also establishes a Firearm Safe Storage Program , authorizing the Assistant Attorney General to provide grants to states and Indian Tribes that enact laws functionally identical to the federal secure storage requirements. These funds can assist law enforcement and courts in enforcing compliance. Furthermore, states and tribes with such laws will receive affirmative preference for certain Bureau of Justice Assistance discretionary grants, encouraging broader adoption of secure firearm storage practices. The bill includes a Sense of Congress stating that failure to comply with secure storage constitutes negligence and should be considered the legal cause of harm resulting from a firearm discharge.
