This legislation amends the Packers and Stockyards Act of 1921 to create the Office of the Special Investigator for Competition Matters within the Department of Agriculture. This new office, situated within the Packers and Stockyards Division, will be led by a Special Investigator appointed by the Secretary. The Special Investigator is tasked with significant responsibilities, including the authority to investigate and prosecute violations of the Act using all available tools, such as subpoenas. Furthermore, the office will act as a crucial liaison between the Department of Agriculture and other federal entities like the Department of Justice, the Federal Trade Commission, and the Department of Homeland Security, focusing on competition, trade practices, national security, and critical infrastructure within the food and agricultural sector. Notably, the Special Investigator will possess independent prosecutorial authority to bring civil or administrative actions under the Act, supported by a dedicated staff of legal and other professionals.
