Summary

The "504 Program Level Flexibility Act" amends the Small Business Investment Act of 1958 to provide the Small Business Administration (SBA) Administrator with increased flexibility in managing the 504 loan program. Starting in fiscal year 2027, the Administrator may increase the total amount of commitments for loans guaranteed under Section 503 by up to 115 percent of the established limit. This authority can be exercised if the Administrator determines that the current commitment limit for a fiscal year could be exceeded. Before utilizing this flexibility, the Administrator must provide 30 days' notice to specific Congressional committees, including the Small Business and Appropriations committees in both the Senate and House. Importantly, this authority is limited to being exercised only once during any given fiscal year.
