This bill amends the Social Security Act to authorize the imposition of civil monetary penalties on certain hospitals. These penalties apply when a hospital's failure to comply with established requirements immediately jeopardizes the health or safety of patients receiving services. Specifically, if the Secretary of Health and Human Services finds such a failure, and has made a similar determination for that hospital within the preceding two years, a penalty of up to $10,000 for each day of non-compliance may be imposed. These penalties are in addition to or in lieu of any other authorized actions, and the Secretary is required to make all such determinations publicly available on the Centers for Medicare & Medicaid Services website. The provisions apply to "specified hospitals," which include hospitals, critical access hospitals, or rural emergency hospitals with an agreement under the relevant section of the Social Security Act, excluding those that are nonprofit entities.
