This bill establishes a comprehensive prohibition on the Secretary of Education transferring functions from several key Department of Education offices to other federal agencies. It specifically prevents new or certain existing agreements that would shift responsibilities like program administration, grant awards, technical assistance, and oversight from offices such as the Office of Special Education and Rehabilitative Services , Postsecondary Education , Indian Education , and Elementary and Secondary Education . The legislation also closes a potential loophole by prohibiting the Secretary from first transferring a function from one of these specified offices to another internal Department of Education office, and then subsequently transferring it to an external federal agency. An important exception is made for interagency agreements that were already in effect on February 1, 2025 , and their subsequent renewals, provided the terms remain substantially similar.
