Automotive National and Economic Security Act of 2026

This bill mandates the Secretary of Commerce to conduct a comprehensive study assessing the national and economic security risks posed by foreign adversaries to the United States automotive industry. The study will specifically examine "covered activities," which include various commercial arrangements between U.S. manufacturers and foreign adversaries or entities they control. These arrangements encompass ownership interests, commercial partnerships like joint ventures, technology sharing agreements, and investments related to motor vehicle manufacturing, as well as associated hardware and software. The Secretary must evaluate the engagement of manufacturers in these covered activities and analyze any adverse impacts on U.S. national security , economic competitiveness , or intellectual property protection . The study will also investigate the involvement of state-directed investment vehicles from foreign adversaries, such as military or state-owned enterprises, in these activities. Additionally, it will scrutinize any transfers of critical and emerging technologies to foreign adversaries or entities they control. Key definitions in the bill clarify what constitutes "covered hardware" (e.g., advanced connectivity components, EV battery management systems) and "covered software" (e.g., for automated driving systems). The Secretary is required to consult with relevant agencies during the study. Within two years of the bill's enactment, a detailed report must be submitted to appropriate congressional committees, and an unclassified version published, ensuring the protection of confidential business information and national security interests.
