STOP Improper Licensing Act

This legislation mandates that the Administrator of the Federal Motor Carrier Safety Administration (FMCSA) conduct an audit of each State's procedures for issuing non-domiciled commercial driver's licenses within three years of enactment. The audit will utilize a randomly selected sample of licenses to assess compliance with Federal laws and regulations, specifically emphasizing licenses illegally issued to individuals who have overstayed their lawful presence or whose lawful presence was not verified. Upon completion, audit findings will be transmitted to States for comment, then published by the FMCSA, and reported to Congress. Following the audits, the Administrator will issue preliminary determinations of substantial noncompliance and prescribe necessary corrective measures for States to implement. States must respond within 60 days, either confirming implementation or submitting a corrective action plan. The bill also requires follow-up audits for States with error rates exceeding 10 percent, with annual audits for those over 25 percent, and authorizes the withholding of all FMCSA funding from States that fail to comply until they achieve compliance.
