Affordable Pricing for Taxpayer-Funded Prescription Drugs Act of 2026

This bill, titled the "Affordable Pricing for Taxpayer-Funded Prescription Drugs Act of 2026," aims to ensure that biomedical products and services developed with federal funding are available at reasonable prices . It mandates that all federal agencies providing research funding or licensing related intellectual property must include a requirement for reasonable pricing in their agreements with developers. The Secretary of Health and Human Services (HHS) is tasked with determining what constitutes a reasonable price. A key provision dictates that U.S. residents should not be charged more for these products than the median price in Canada and six other specified large, high-income economies. The Secretary of HHS can also establish additional requirements to ensure reasonable pricing, considering both the public interest and incentives for research and development. While the Secretary can waive these pricing obligations if it is deemed in the public interest, such waivers require public notice, comment, and an economic analysis. Furthermore, manufacturers must report clinical trial costs, federal subsidies, and annual revenues, which will be made publicly available to enhance transparency.
