Stop ICE’s Medical Neglect Act of 2026

This legislation requires the Secretary of Homeland Security to establish a publicly accessible, online platform for individuals detained by U.S. Immigration and Customs Enforcement (ICE) or U.S. Customs and Border Protection (CBP) to submit complaints alleging medical neglect. These complaints can be filed by the detained individual, their legal counsel, or a family member, and must include specific details about the alleged neglect and facility. All complaints submitted through this system are mandated to be confidential and cannot be shared without the subject's consent. Upon submission, each complaint will be reviewed by a contracted medical expert to determine if medical neglect occurred. If neglect is confirmed, the Secretary must ensure the individual receives necessary medical treatment; if not, the complainant may appeal the decision to the Office for Civil Rights and Civil Liberties. The bill also explicitly prohibits any retaliation or adverse treatment against individuals for submitting complaints or communicating about their detention conditions or medical care. Furthermore, it requires the provision of language translation services and defines "medical neglect" as the failure to provide timely access to medically necessary care, continuity of treatment, and other essential health services.
